Logbook with occasional driving

    In order to meet the short haul regulation he has to return to his home domicile at the end of his shift.

    The way I read the OP's post, he's not simply going out over 100 air miles and then coming back, which is the exemption you're all pointing at. When he said he goes "over the road" I assumed he's staying on the road a couple days a month.

    That disqualifies him from the short haul exemption, and demands him to have copies of his logs from the previous 7 days, even if they were spent local.

    Sorry I guess my original post was confusing. If I go farther than 100 miles I still come back to the shop at night. No overnights out on the road.

    I'm trying to figure out for sure if that even matters now and I can't find what I'm looking for. Guess it's time to break the book out.

    If I'm still wrong somebody tell me because this ones gonna bug me haha

    He CAN NOT claim the exemption when he goes outside of the 100 air-mile radius. Just like he CAN NOT claim the exemption if he doesn't return home that day. ANY day that he does NOT qualify for the exemption, he must fill out a record of duty status FOR THAT DAY. He does NOT need to go back and recreate driver logs for the previous 7 days if he had been exempt on those days...which is what the guidance states. If I work 12 hour days, return home, and don't go past 100 air-miles for 3 weeks and then accept a run that will have me out 3 days, I only need a log book for those 3 days I do not qualify for the exemption. That's what the guidance says.

    Granted, it would be a good idea to have a copy of your time card with you to prove you aren't over your 70, but again, according to the guidance, you do NOT have to go back and recreate previous days logs when you were exempt on those days.

    Also the people you call into the thread using the @name trick then they come in asking what you want. then 2 days later they clue in and read the thread and catch up duh.

    I think I found what I was looking for.
    The recaps/total on duty time for the past 7 days is what has to be shown regardless.
    As far as keeping logs of the days I was wrong. It appears you don't actually need copies of them. Just total on duty time for your current days when logging becomes mandatory.
    Does that make more sense?

    I had this discussion with a dot officer.
    He said when ever you drive over the 100 mile exemption it triggers running a log book and then running a log book triggers you must have the previous 7 days.
    So I don't know.......

    I know that's not what the op ask. That was answered in the second post. I was pointing out the fact you can go farther than most realize running under the local exemption.

    I do this a lot and I fill out something similar to this http://www.hoovestol.com/files/Seven Day Prior Log.pdf

    and have it with me when I go.

    I am not 100% sure it is even required based on the guidance but it takes about five minutes to fill out and seems like a good idea.

    That's a DOT man who needs to read the guidance. FMCSA is pretty clear on the matter. You do not have to draw up the 7 previous days logs just because you'll not be eligible for the exemption today. Doesn't matter if you exceed the 100 air-mile radius, work past the 12th hour, or stop somewhere other than where your day began...ANY of those things trigger the need to complete a RODS for the day.
