.297 is pretty close to alcohol poisoning. You have to really chug-a-lug to get there, especially if it's beer. Hopefully they take his license for a good long time.

 

License? If the state proves their case and there isn't another reason for his intoxication, he should never have to worry about driving a commercial vehicle again. Sadly 1st offense in our state is civil offense. Not even criminal.

I witnessed a homeless, assumed alcoholic, known liquor store thief blow around a .26 while an officer was demonstrating the real world implications of alcohol. The man humored us and showed ZERO signs of impairment. He effortlessly rode his borrowed mountain bike up to us, stood on either foot, touched his nose and walked the line. He didn't perform the nystagmus test as the officer wasn't qualified and certain neurological conditions (alcoholism?) exclude that and they go right to a blood draw.

Regardless that poor soul could hold his booze "better" than a non-alcoholic fit late twenties early 30's man at .10
At the moment it dawned on me how tragic alcoholism really is.

That and the fact that unlike heroin, opiates or whatever alcoholics will certainly die if they don't continue to feed that demon.
