I learned something so sorry I fertilized the weeds. The IRS needs to shorten that publication. 50 pages!

If they pay you $55 a day and you can only claim ($63*80%) $50.40 a day, they are overpaying you M&IE which it really is not Per Diem. You might want to let your payroll department know this. You are basically owing the IRS $4.60 per day. IF you company is part of the IRS Per Diem program they cannot take out more than what you can claim.

Yes you can, but your employer cannot take out more M&IE than what you can claim.

Please note, this is the only Pub put out by the IRS that even mentions Transportation Workers.

Where on the tax form do you enter the per diem deduction?

Not unless he's a 1099 contracter or an o/o. Otherwise it is schedule a.

I'm a company driver. But, the company doesn't do per diem for us. I just keep track of it in a spread sheet. I have the total amount (63 a day) * 80% for days gone and 75% for the day I arrive home and the day I leave every month. I just didn't know where to put the amount on the tax form. Thanks!

My company pay includes 8 cpm, so days when Im not driving, taking a 34 etc, Im still entitled to the $50 a day.
Multiply full days out x50 and subtract what employer paid me, and write off the balance.
