“The movement from a shipper or receiver to the nearest safe resting area may be identified as personal conveyance, regardless of whether the driver exhausted his or her HOS, as long as the CMV is being moved solely to enable the driver to obtain the required rest at a safe location. The Agency recognizes that the driver may not be aware of the direction of the next dispatch and that in some instances the nearest safe resting location may be in the direction of that dispatch. If the driver proceeds to the nearest reasonable and safe location and takes the required rest, this would qualify as personal conveyance. FMCSA recommends that the driver annotate on the log if he/she cannot park at the nearest location and must proceed to another location.”

Prime has turned off PC for the drivers; they now have to call in to make their case to the compliance department in order for it to be turned on.

 

Or switch to Yard Move and keep it just under 20 miles per hour...unlimited movement...

That's not allowed. What he could have done was find some legal parking somewhere, then went on PC, notating it as going to find a restaurant. That wouldn't be true, but it wouldn't be so obviously illegal.

 

wait really? I'm not sure how I feel about that. That seems like it could be cool or it could just be a stupid pain in the ###. Because, I was forced to use PC all the time when I worked with prime. Because they kept having me run these loads that couldn't possibly fit in a schedule. So I'd have to PC from the receiver to rest stop. Or PC from the rest stop to the receiver if it didn't quite fit into the hours properly. Which is against the rules but there wasn't really much else I could do if I wanted to make the load. So, I kind of see this as a good thing because, it'll force them to actually start giving people proper load schedules that can fit into the regulation hours.
