Question about the ELD mandate

    Hello,

    My name is Eric Li, a graduate student at University of Michigan. I am doing a school project to understand the impact of the (D.A.M.N) ELD mandate. If you own a class 8 truck, I would greatly appreciate 1 minutes of your day to answer several simple questions.

    1). Are you leased to a company or do you run as an independent O/O?

    2). If you have to use an ELD, would you purchase one by yourself or use the ELD specified by your company?

    I am an O/O currently leased to a company that is looking to put eld's in to comply with the mandate. Federal leasing regulations PROHIBIT forcing a contractor to purchase ANY product OR service from or through the carrier as a condition of entering into the contract. That includes ELD's. If they want to "make it available for purchase", then we as O/O must have the option to go elsewhere and buy a device and subscribe to a service on our own. If the carrier is going to eat the full cost, they can mandate the specific device and subscription. They cannot, however, say "this is the device you must buy from us, and then you must pay us $xx/month for the service" because that is a direct violation of the law.

    O/O's need to put their foot down on this, though. Too many just assume that it is the way it is and go along with it because it's easier to bend over and grab your ankles than it is to stand up and fight for your rights as an independent businessman.

    If I have to, I'm prepared to get my own authority to avoid this ELD crap. I will not put one in my truck. Period. End of sentence.

    I drive a 1999 , with my own authority and already are in compliance.

    The ELD mandate is full of holes and will not pass.



    End of sentence period.

    I am an independent with an early 2000 titled year truck. It was built in late 99 and it will magically turn into a titled 99 in the 11th hour.

    The 8th last digit of your Vin will determine if it's a 99 or a 2000 ... needs to be x for 99

    1. I am leased to a very small company making me as much independent as leased to if that makes any sense. (I receive a high percentage and pay my own liability. Unfortunately most of my work is coming from the board right now too.)

    2. We are pretty much standardized on BigRoad without the hardware tying it into the truck (basically digital paper log) so the natural progression will be for everyone to get the box for BigRoad. We will undoubtedly foot that bill.

    Will not pass? Already has been mandated by congress in 2012 thru the MAP-21 legislation to be put into place and FMCSA has gone thru the OMB process and implemented the ruling last December. The question is more about whether it will be put on hold or rescinded.

    What are you talking about it will not pass? It unfortunately already passed, it's the law... they're waiting to "enforce" it by December 2017... you have a year and a couple of months to get compliant because by that time you'll start getting fined. It is known that ooida is trying to fight it but I'm not holding my breath. I hope shet blows up when that time comes and reverse it. What this mandate does is make people realize how stupid and facked up the Hours of Service are... forcing you to gogogogoo because the clock is ticking, and that stupid mandatory break, and how any time off duty doesn't count towards the break.. list goes on and on. What we need is to loosen up the hos so we're allowed more freedom to work.

    We are all different, we work differently etc, shouldn't follow same rules, it should be more of a guidance. I am completely against fatigued driving/working (which is what we gotta do now). Any accidents causes by it should be severely punished. Cops, firefighters, nurses, doctors, etc work countless hours and they don't have to do a logbook. Rampers at the airport work 17 hrs double shifts all the time... don't understand what's the big deal with us.. stupid beourocracy and corrupted government getting money from carriers via lobbying and then selling it in the name of "safety" just because ####ty companies can't sell a product so they get the govt to pass a law so they can make money.

    That's how America works... best business investment there is, are politicians. Look it up, countless times companies have spent a few millions buying politicians to get billions in returns!!!!!! Ugh... anyway I've said a lot.. I'm done.
