Hello I guess it's been about a year since I last posted here. A bit about my incident. I'm from New York and I was involved in a fatal accident in which a moped operator struck my truck resulting in the fatality. I was charged and convicted of failure to obey traffic control device due to the lawyer that I hired failure to properly defend me. According to new yorks rules regarding how long an accident stays on my record it will be removed next January. Currently I live in maryland and I plan to transfer my license and use the workforce center to obtain my cdl however I'm curious if I will have trouble finding work. I'm also curious of weather the accident will show up to carriers now that I'm in a different state. What are others thoughts? Also a couple more things to add I currently have two active suspensions that are on my record the first was during the administrative review because I receive survivors benefits do to my diagnosis of bi-polar the judge ordered I get a medical review and it took me several months as the clinic I went through waisted my time. The second suspension was caused by a ticket i got it was another failure to obey stop sign ticket. The court didn't send the court date to the address I put on the ticket and I missed my trial so they sent an order to new york to suspend my license. I called them and got the order reversed which I sent to ny dmv I found out recently that the idiots suspended my license anyways and after some angry calls I got the suspension removed not sure if it's even on my driving record. Lastly the officer didn't show up so the ticket was dismissed.

You've had a fatal for which you were found at fault, two suspensions, and you're seriously enough bi-polar that you receive a disability payment?
I don't think truck driving is where you want to be right now. Give it a few years and let your driving record clear up.

I never heard of getting survivor's benefits for a disability.

    Do you mean SSI/SSDI benefits?

Anyway, you are unhirable with most insurance companies, the charges and tickets DO NOT vanish from your record even if they are "expunged".

Most mid to 'Mega' sized carriers will find your NY abstract and will do the required reference check(s) of your employment history.

In fact, despite the 'come off your NY MVR' you've researched, the fatality may still show on the services used by most carriers.

Additionally an accuratey completed Part 391 Application would still cover the accident/suspension and honesty will be your friend.

Suspensions for unpaid traffic tickets happens and carriers see it all the time.

Most carriers immediately terminate any candidate found to be falsifying their Part 391 Application so, again, honesty is your friend.

You can expect to receive a lot of 'NO WAY' responses BUT someone will interview and may decide you can work for them.

The problem may be the carriers that do accept you might not be the best and most honest in the business.

Time is going to make your decision, it could take a lot of applications just to find one crappy job, how long can you afford to look for a trucking job VRS making a living.

The fact that the accident will still show on the abstract even though it's been expunged

Insurance companies and other investigation services will pull ALL of your records unless they are of juvenile or family court (dealing with issues as a child) proceedings and sealed. Your record, no matter what is sold to people can be found, every ticket, every court decision, and so on is still there.
