1. Off Duty
2. Peeing
3. Pooping (PC filters require this word)
4. Pre-tripping and safety checks
5. Coffee, meal, and BS breaks
6. Sleeping
7. Other Sleeper berth activity
8. Driving
9. On Duty not driving
10. Arguing with dispatcher or customer
11. Attending to LEO and the inspection or issuance of a ticket

lost and found stated "if in sleeper berth and log as off duty,this is falsification"
if im in the sleeper and decide to mark it off duty because i was watching tv,or what ever its not falsification. hes stating just because your in the sleeper you have to list it as sleeper berth. or your falsifying.
and how do you get 6 or 7 lines out of my statement? when i said sleeper berth=sleeping driving=driving working= on duty off duty= everything else

I found some clarification and obfuscation.
395.8(h)(2) says "A continuous line shall be drawn between the appropriate time markers to record the period(s) of time off duty resting in a sleeper berth...
This seems to imply that sleeper berth is considered off duty. So maybe?...
However 395.8(h)(1) says "Off duty. Except for time spent resting in a sleeper berth, a continuous line shall be drawn between the appropriate time markers to record the period(s) of time when the driver is not on duty, is not required to be in readiness to work, or is not under any responsibility for performing work."
So if you are watching TV in the sleeper berth you are off duty, line 1. I doubt they would fine me for recording sleeper berth as line 1 as long as it is at least 10 hours total but this seems to say I shouldn't. What if I sleep in the passenger seat? Line 1? -
Tell you what. Pull into a scale with Sleeper-Berth time logged as Off-Duty and tell the enforcement officer that you were, in fact, in the sleeper berth. Let us know how that works for you. Is it time spent resting? Yes. Is it log falsification? Yes.
And if you're sleeping in the passenger seat? On-Duty.

I have always been told if your in the sleeper to log atleast 10 hrs but that you can log it as off duty also because your not doing any work related actions. Personally I log 10 SB unless its a restart then I mark OD. I've never had any issues with DOT as I show atleast 10 continuous hrs. Right? Wrong?

Log as you do, do as you log. In other words any time spent inside the truck use line 2, if you go in to use the facilities, log line one til you get back and remember to flag the city and state for change of duty. If you logged 10 solid hours in the sleeper DOT dude might ask you where you relieve yourself. Same thing when split breaking, if you drove for so many hours then logged sleeper for 8 solid hours then logged drive time again, you're raising red flags with DOT even though it's perfectly legal to do that. -
