I kinda need some serious advice. Anyone that has been following my threads knows my carrier in my area is going to crap. Aside from the lack of hours and lack of start time, I have some complaints.
One of my biggest complaints is that I am referred to as the "yard-n*gger". I am a P&D driver like everyone else, but my job is to hook everyone's trailers and start up their trucks and hook them up to their respective trailers that they will pull. I don't have an issue doing mundane yard work... but this is the first job where I am being referred to by a racial slur. I am not fully white. I know the person in charge is old school and is used to referring to minorities by using racial slurs.
My question is, do I have any legal rights to fight against this?

Don't care what color you are, be pink with purple dots. Being referred with a racial slur is a HR issue. Are you ready to burn bridges? If they do not fire him , you will still have to work with him. I was faced with starting a HR issue (for something different) , but saw it may have made things worse. If ready to leave , start the ball rolling , then when the poo hits the fan , leave.

That wouldn't be tolerated where I work if you complained to HR about that "corrective action" would be taken.

Then, if that doesn't work, go to your HR people. If a verbal complaint doesn't work, then put it in writing to them, of course keeping a copy yourself, for possible further action.
If the written complaint doesn't work, then take it to a lawyer. By this time, you have taken reasonable steps first.
Be prepared for the possibility of a couple of things to happen, if you have to take it to your HR department. First is, the harassment may stop for a while, then resume. The second is you'll get a snitch and troublemaker jacket hung on you, and you can expect possible retaliation. Anything from verbal harassment to them finding, or posibly even creating a reason to fire you.
Of course should either of these happen, take to a lawyer.
You possibly already have a good case here, but it will be stronger if you use the above.
Keep in mind, that the employer probably has something similar in steps they take in disciplinary action against employees. You will just be turning the table of escalation around, and using it against them.

Hi guys, what's happening today?
I just woke up from my afternoon nap that I took today. I left the yard this morning at 2:15am that'll be a new Tuesday thing, because I've had a stop permanently, put on me.
Anyhow, got to my first stop at 2:37am and I was off and running after that. I made it back to the yard before one pm, that was pretty cool had a lot of cases, but the stops came off pretty good and cut through everything alright.
Trying to find a person to give me a mortgage *again*.
This one more likely then not might be the one. Have to look a little closer, the realtor (kind of a big a-hole) thinks there will be an open house on Sunday.
Anyhow, that's pretty much about it in the fast paced world of my life. -
Well we are still busy as all hell, (still looking for a driver) but we manage, its a lighter week due to thanksgiving, so it was just a mild panic rather than our usual full blown insanity
