Write it up on your Driver Vehicle Inspection Report (DVIR) as Defective Brakes. You do have the written failed inspection from Love's certified qualified technical mechanic. You do have a Commercial Drivers License of which one of the things qualifying you to carry that was being satisfied in the safety of your equipment.
Use the tools you have there and look through your green book to back you up. You're gonna have to take a stand on this one against your boss. He isn't going to like it, and I'm concerned his statement of not trusting the Love's techs just means he is low on funds to fix the equipment. He'd rather you risk your life and his own operating authority above and beyond the dangers we already face rather than make his equipment safe and legal.
If he still resists and insists, then it is time for him to authorize a $1000 comdata or EFS check to you above and beyond your mileage pay for that load.

There is a grey area between whats safe and unsafe when it is the opinion of the company management. Total Brake failure is unacceptable. Yet there is a point when the term, " needs repair " signed by a certified brake tech will get the trailer to a shop for repairs. As what you must do, should be responsible for your actions regardless of the man who signs your paycheck.

I appreciate all the replies and yes I would get hammered if I showed up at a scale house and reported the bad equipment. So I’ve decided to just go with it. The brakes held as I adjusted my weight and I didn’t have a problem driving I80 on snow and ice. I have lost all respect for the owner and my manager has as well. He’s assured me things will be different in a couple of weeks as I will be jumping into a newer truck and trailer. I just wish FMSCA had some way to make these reports about bad employers without me losing my job. I guess this is to be expected with people from Russia, Bosnia and Serbia.

You shouldn't let your boss intimidate you into doing something you know is wrong he's going to take advantage of your good nature.Keep in mind its your cdl and your boss washes his hands of everything and knows nothing once you take bad equipment.If you lose your job it just shows your boss could care less about you or your cdl is it worth it?supremegod, NavigatorWife and chilibowl Thank this.

Your Boss does have a valid concern about not trusting the truck stop shop. They are salesmen that will try and sell stuff when the old stuff is still legal. They will use scare tactics and let you know "they can shut you down for that". Hard to say whats going on unless you know the tire and brake conditions and measured them yourself.
If things don't change in the future and things are still bad don't roll into a scale with bad equipment to tell them about it. You chose to drive it like that so you can take heat for it. It would be better to call them and let them now there are serious issues at the workplace and they will come there to check things out.
Sometimes it's just better to find a new job.
