Sleep apnea and cpap machine.

    My question is simple. The company I am with when new drivers sign on on go for there DOT physical and drug screen. Is it legal for the doctor there to force them to use a cpap machine just because they are over weight or have a big neck, without doing a sleep study, or any other test to see if they have sleep apnea.

    They would need a sleep test to know if a driver has sleep apnea. They need a prescription to get a cpap machine. A new driver can say no and work some place else or go to another D.O.T physical doctor. Sleep apnea is not a law but the doctors basically look for big neck or overweight drivers and say they won't sign off unless driver gets checked. The first part of a sleep apnea test is to see if someone has it. If they don't a driver would be done and could get medical card. If a driver does he would have to go back for the second sleep test or they give someone an automatic cpap.

    You can't be made to use a CPAP without having a sleep study first. CPAP delivers oxygen at a measured pressure and rate while you sleep, just wildly guessing at how much you need could seriously damage your body.

    Which is why they make you take a sleep study first.

    no it is not legal. the doctor can follow "guide lines" regarding ordering up a sleep study test. weight to height ration, neck size, sleeping habits, and right now, i am not sure if BMI is included into the guide lines.. this is why i hate the DOT physical. some places here tell you IT IS THE LAW.....well BS, it is THIER LAW, most likely get a kick back for the testing company.


    i think some DOT doctors take it too literally about the guidelines.

    You right fam. My entire point is null and void because I said oxygen instead of air.

    Does the cpap this doctor wants to sell you have some kind of reporting of time or percentage of use? If no, I would just take it and store it in the cabinet.

    A lot of Physicians are stuck on the Sleep Apnea thing because they know the DOT is intending to make it part of the medical qualification process.

    Those doctors in very litigious places and/or those with already extremely high malpractice insurance costs are covering their butts, probably, in an attempt to limit their malpractice costs from rising by going 'above and beyond' what is required

    Misdiagnosis and prescribing an unnecessary treatment also constitutes malpractice.
