What I 'we' used to do was if they questioned if you would hire the guy back, you'd either say "absolutely", or "I can't comment on that". Either way, the person on the other line got the message.

Of course the opportunistic people that owned the #### hole wanted an accident report. I took a lot of photo's and so did the police officer who even agreed with me that it was a jury rigged set up and the weight of the wire had it bending down in the middle probably less then 10 feet off of the grade. He looked at the rusty bent pole and smirked while he shook his head. I immediately called my employer and reported it.
Fast forward 3 months later in May and some guy tried to squeeze by me when I was merging to the right from the center lane because the left and center lanes were closed for road repairs. So my passenger side bumper put a scratch in his driver side rear quarter panel. His wife sticks her head out the front passenger seat and starts waving her smartphone around while cursing me out.
Called my employer from the side of the road and he said take photos and get a copy of the police report. 1 month later he calls me into his office and says his insurance company said I was ineligible driver.
1 week later I started a new job driving a 53' flatbed trailer hauling construction materials for less pay. I went on an interview today for a much better job and they want to hire me but said first they have to run my MVR. I paid 7 bucks for my NYS DMV CDL abstract and it does not show those 2 accidents. The owner/employer said that his insurance company may show that and say ineligible. I'm home now waiting on them to call me back.
The first ineligible report in May 2023 said it was those 2 minor accidents plus I had less then 3 years experience. On December 8th 2023 was my RT passing anniversary so now I have over 3 years experience and the 2 minors. Got my fingers crossed.silverspur and TruckND Thank this. -
'Company Policy Violation' is just that... a company policy that the employee didn't practice and it IS NOT reported to DOT, or FMCSA. Any company can create their own policies and terminate if such policy isn't adhered. For instance, a company could state that "employee must maintain 'minty fresh breath' when in the presence of any customer, or any potential customer" - yet said employee chooses not to brush their teeth and prefers to chew cinnamon gum. By all means it is a direct violation of 'Company Policy' and could result in termination.
As ridiculous as my example may seem... it is exactly what a 'Company Policy Violation' is.
It is up to the hiring employer to find out from the terminating employer the reasons of the termination. In most cases, the terminating employer WILL NOT disclose any additional information other than 'Company Policy Violation' - because the terminology allows the terminating employer to be extremely vague and protects the terminating employer from any legal actions.chimbotano, catdog45 and TruckND Thank this. -
