Kinda hard to give someone the benefit when their last statement is so off base though isn't it?
Either way, will find out tomorrow what the damage is going to be, $$$ wise.

Estimate from the dealer, plus my down time for the 3 days for the repairs, comes to @$4600. Now USA are saying they will have someone contact the dealer regards the repair costs etc. They probably crapped themselves when they saw an OEM WS bumper costs @$1500. Tough, thats what it had before their drunk ###### hit me, so thats what it will have afterwards.
They are dragging butt now, so it will probably end up in court in Sioux Falls, where they have the police reports etc.
After that, unless they change their tune, it will be emails to their biggest accounts, with a certain video as an attachment.
For under $5k, the 'tards got away VERY luckily IMHO. Heaven knows what they would be paying if that kid had managed to leave.
All in all, NOT a good experience. Looks like they will go the same route as other bottom feeder trucking companies, not wanting to pay to fix quality equipment with OEM parts. A NEW Western Star isn't a fleet POS truck, so I guess they need to send a memo out to only hit those from now on....

I just talked with the owner of the businesses access the street from me that a USA Truck pulled the power feed lines down from.
USA Truck gave him the complete run around and if he wants to get compensated by them he will have to get a lawyer. Its more money for the lawyer then to get repair the damage and as he has a son who is an electrician he decided to just eat the cost rather than hassle with a lawsuit (Im sure that is what USA Truck was hoping for).

It's a fight with the big companies. I was side swiped a couple years ago by a Stevens driver while I was sleeping on a side street. It took a couple months to get a check from them. I did get compensated for 2 days downtime (shop) and my truck was driveable after the accident but it still stunk. The biggest issue is taking them to court would have cost me another few days of missed work so I took the settlement check, patched up the truck and moved on. Thank god it wasn't a new truck like yours. I hope they do right by you.

Still no contact from some guy named Eugene Duncan there today.
Will try to call the DA in Sioux Falls tomorrow.
If I get screwed, I WILL share it around though...

I would just call their insurance company and let them take it over. USA is going to drag their feet in hopes of wearing you down and you just going away. I know that getting the insurance companies involved is not the best way to go but let them buy the lawyers and fight it out amongst each other. You were hit by their driver, there's pictures to prove who hit who. You even have video of a guy who wasn't doing so well on a field sobriety test but in all actuality that video won't stand for anything in court because the lawyers for USA and/or their insurance company will show that there's no proof the guy in the video was actually the driver of the truck. Everyone except a couple of tools on this forum believe it was the driver but the lawyers will have that video suppressed as evidence in an instant.
I wish you the best of luck in your uphill battle with them, just be careful what you say and where you say it. I was running down the highway in Minnesota a few years (about 18 years) ago and some idiot farmer chased a cow right out onto the highway in front of me. Let just say an 800# cow does some serious damage to the front end of a 379 Pete. Well even with all the witnesses, the statements etc. the guy got out of paying for any of the damage because of one little comment that I made "now I'm not going to make my delivery on time". His insurance company lawyer turned that factual statement against me and the end result, he didn't have to pay because I was in a hurry to make a delivery appointment even though the two witnesses running the same direction I was said in sworn statements to the court that I was driving under the speed limit and had been since leaving Worthington. The worst part, I made that comment joking with the tow truck driver but both the owner of the cow and the cop heard it and it was used against me.leftlanetruckin, The Challenger and Sleepy68 Thank this. -
