Ticket in Personal Vehicle Employer.

    One of the papers they have you fill out in orientation is going to be an Annual Review of your driving record. You must list all violations of motor traffic laws and ordinances of which the driver has been convicted or an account of which he/she has forfeited bond or collateral during the preceding 12 months. Code of Federal Regulations 391.27

    There are further reporting requirements the driver is to furnish the carrier within so much time of a motor traffic law violation but I don't have the cfr right in front of me.

    It is best to tell them now, carriers have some sort of alert system set up with the DMV (California for sure, this happened to me). My carrier sent me a message my CDL was to be suspended in one month for some petty BS. Talked to the safety dude who said the DMV alerted his office about it so he was just informing me what they told him. I got it all straightened out and even got an official letter from DMV stating they had purged all reference to the suspension action in their database.

    Ah bro that sucks. I hear (dont quote me on this) that a cell phone ticket is on par with a DUI as far as a barrier to employment.

    I actually throw my phone in my trunk when i drive my personal vehicle now.

    Fight this ticket. Get yourself a really good lawyer.

    and if there is an emergency, you gotta pull over get out, open the trunk, make a call, and get back in the car, all the time hoping, you don't get hit by a passing car..???

    well i was VERY impressed with myself, as i typed it up. what kind of person does not have his/her cell phone beside them when driving, not using it, just beside them, in case of an emergency. so you say you leave yours locked up in the trunk as you are driving.>???

    i call BS on that. in case of an emergency you got what, at the very least 2 choices....be a human being and call for help, or be an acehole and ignore helping someone in dire need.....

    and what if YOU or someone in your personal vehicle has a medical emergency, you got the time to stop, get out, open the trunk to make that call, all when seconds count..???

    again, i say you are full of shyte.

    You act like 20 years ago before everyone had cellphones there was pure anarchy in the streets and drivers were murdering people and eating each others babies or something.

    Get a grip old timer. Put your phone down for 4 minutes, i ####ing guarantee you the world will continue spinning exactly as it was before.

    It will not take a year for them to find out about a ticket. There is a service that most subscribe to and when your info is run by the police they get notification in a day or two.

    If you've already been convicted, you better own up to it, cause you're gonna get fired for cause if you don't. If you have NOT been convicted, fight it. Hire a lawyer if you need to. This IS a big deal. Seriously, cell-phone use is one of the trips to NEVER HIRE land with most of the companies you want to work for. It costs the COMPANY $11k if you get cited while driving a commercial vehicle. If you have one in your POV, ya, they're gonna look at that VERY closely.
