Yes. Under 49 CFR §395.8(a), drivers must record their duty status for each 24 hour period, including all on-duty time. The definition of "on-duty time" in §395.2 includes "performing any compensated work for a person who is not a motor carrier." Therefore, all compensated work, whether for a motor carrier or not, must be included on the log as on-duty time and counted against the driver's available hours.
So you can only work legally 72 hrs in an 8 day period and everything you get compensated for counts against that. So 40 hours behind a wheel and 30 at McDonalds in let's say 5 days. You my friend are out of hours.Last edited: Dec 14, 2015

"Under the 70-hour/8-day limit, you may not drive a CMV after having been on duty for 70 hours in any period of 8 -consecutive days.
Keep in mind, that under either limit you may do non-driving work after reaching the 60-hour or 70-hour maximum, but these hours must be added into your total."
