Tow Truck Ripped Off My Bumper, who is at fault?

    bumper.jpg [​IMG] Tow truck driver lowered my tractor steers down onto some 4x6's and the truck rolled backwards off the wood, the bumper caught the lift and ripped right off. He was like "you forgot to set the brakes, here sign this paper real quick"...

    You need to give more details ..like why was he setting it on 4,×6's and who's decision was it to do that ?

    So who's responsibility was it to set the brakes in that situation?

    Had to set it on 4x6 because the lift would not go low enough to clear the bumper. The plan was to drop it on the wood, then use the bumper hooks to lift the truck up enough to get the wood back out.

    Well, I would say the tow truck driver since they do that every day. Yes I signed it before I read it, it said something like we the towing company are not responsible for damage.

    He is, it was on hook and his insurance is responsible to fix the damage.

    Don't sign anything, not even a receipt without making sure it doesn't put responsibility back on you.
    Also, how the hell are you going to be in the tractor while recovery operations are on going?

    The question isn't whose fault so much as who'll end up paying for a new bumper. Obviously it was the tow truck operator's responsibility to get it there damage free. If he had you quickly sign it probably released their company from any claims not noted on it. I'd contact the tow company . Maybe someone in charge has integrity.

    Gotcha .. I'd like to say it is his fault because he was hooking up for a tow .. but I 'am not a attorney
