    I'd hate to be that Defense Attorney.

    Also.. all the guys on Trucker Path, and other parking apps that always ask.. " Do they sell beer???!!"..
    This is what that leads to.

    I like a beer or four as much as anyone. I can wait til I'm at home.

    He rejected the plea deal? He's going to jail, the only question is for how long. It sounds like he was only being sentenced to 10 years, so he probably would have gotten out in 7. Now he is susceptible to 30 years, which he deserves, what an idiot.

    §382.303 requires drug & alcohol testing post-accident, whether you are cited for the wreck or not, IF there is a fatality. Alcohol test is supposed to be performed within 2 hours, and no more than 8 hours after the crash. The cops don't need a warrant to perform this test, because it is required by the regulations. The regulations also state in section (g)(1) that the cops can test breath or blood instead of the company.

    Bottom line, there isn't a snowball's chance in hell that the blood test will be thrown out, because it was a required test under the regulations governing the job he was performing at the time of the crash because of the seriousness of the crash.

    Most Lawyers wanting to train for a lifetime of defense or prosecution in Court generally have a exercise in indicting a ham sandwich.

    I can remember when this first happened. There wasnt any knowledge of how fast he was going and people were speculating the road was over posted for speed. Him doing 55 in a 35 zone. Alas 88 is way too fast for that turn. Least to say he had a history of driving abuses. I just hope the law is able to keep this crook from pulling anymore loads. sigh

    IMO he should be done, as he certainly earned it by killing two people because of his stupid actions.
