Even in Florida. You cannot legally shoot a person who is retreating.

While not the case, as it did not happen that way, Joseph was alluding to the Trayvon Martin incident.

I know what he was alluding to, and in ANY state, you have the right to use whatever means available to you to stop a person from bashing your head into the concrete sidewalk...lethal or otherwise...in order to stop the attack against you. In EVERY state, including "stand your ground" states, you cannot shoot a retreating person because a person in retreat does not pose an imminent threat to your safety. Once you go on the offensive, you become the attacker.

Or the 4 wheeler was just a bad shot. Even a 9 hitting somebody several times should have incapacitated them. Lucky truck driver yet another case of a moronic 4 wheeler. And yet another case where Obama can say we need more gun control. No we just need more responsible fire arm owners. And then people wonder why I carry....

In defense of some tough SOBs I know who are no longer with us, the truck driver should thank God those shots weren't better placed and learn that it isn't worth it.

If it isn't in self-defense, it doesn't make sense.

Several years ago, crap like this was happening in LA almost every day. . .

Well, we don't know what kind of training the shooter had, but to be running and shooting at a moving target, after just being attacked can be stressful.
The shooter was a freaking idiot here, wonder how many rounds he fired that DIDN'T hit the driver, and could have hit someone else. . .:biggrin_25512:

Basic hunters safety says know of what's beyond your target this could have ended easily in numerous fatalitys.

It's like your dad comparing a 22 to an air rifle when you're a kid. An air rifle may shoot 100 yards a 22 will go a mile and a half or farther depending on conditions. It's a bad situation to say the least who knows how it will unfold

Reminds me of one of our drivers when I was at Crete years ago who got into a road rage incident....with an off duty cop, who pulled his service weapon and fired...end result, 2 lives ruined and 2 families devastated. 1 dead truck driver, 1 former law enforcement officer serving life in prison all over a misunderstanding.
