Trucking co involved in fatal accident in Terrell tx still operating illegally post crash

    They need live people to do the shut downs - a little thing called due process. One owner having multiple authorities isn't necessarily a red flag. Neither is multiple carriers operating out of one yard - think of multiple, legitimate, 1-5 truck carriers working out of here. There are at least 5 different companies running out of Hribar's lot in Sturtevant.

    Secretary, Duffy needs to put on it order to put these guys out of service as an eminent safety, hazard and threat to the motoring public…

    This problem is much worse than anybody wants to believe it is at this point I guarantee they pull the wool off and turn the light on. It’s pretty bad

    Choice "B" is actually still Choice "A". FMCSA had it's budget slashed in FY 2018, the same year it ended on site new entry audits. It wasn't until 2023 that FMCSA funding reached 2017 levels. Total staffing levels look about the same every year since 2017, but I'm not sure on that.

    Choice "C" is what they should have done in 2018 when new entrants spiked - suspend issuing authorities until the back log of audits is complete.

    Choice "D" is for Congress to not put an ATA shill in charge of FMCSA.

    Choice "E" is to make shippers and brokers legally liable for the actions of the carriers they hire - but there's no chance of that happening.

    How about choice 'F'
    Every examner who issued a license to someone who clearly couldn't speak or understand English, gets to go to jail.
    And every examner who issued licenses to these people who are involved in an accident will be held criminally and civilly liable.
    Might slow the tide a bit.

    Due process? Compliance review can be done electronic, program determines fines and rating. That's been done for years that way.
    DB can be determined electronic and rating changed.
    I've had 5 compliance reviews in 27 years, pretty good idea how it works. How many have you personally had?

    I'd go a bit further, but less extreme - any one with a CDL who can't pass a company's check ride on Day 1 has their CDL revoked and the examiner also has their CDL revoked.

    Also, for every OOS violation the CEO of the company faces 30 days in jail. Because that's the prime mover - companies can profit with little to no risk to themselves.

    I'd also like to see states doing more enforcement. The last open weigh station I saw was during Road Check. Granted I'm running nights, but can't we get a weigh station running on one random night a week? But that costs money, and it seems like CMV enforcement is a very low priority.

    Fun Fact - there's a 'virtual scale' on I-41 South just before the Butte Des Morts bridge. Every day it records more than 20 CMVs over 100,000 lbs. WSP wants to station an officer on the other side of the bridge - if he catches one of these guys a day they could cover his salary in a month.

    It hasn't been done by a computer. The documents have been submitted electronically, but they are reviewed by a person.

    And if electronic compliance review works, and it's been done that way for years - why are the bad actors increasing?

    I also doubt you'd appreciate your authority being deactivated because I applied for a new authority with your address.
