Violated hos, company wants me to sign a form? should i be worried?

    I too have spoken to not only FMCSA auditors, but I have also spoken to some state auditors as well. I have had more than one conversation that went something like this. " if we were so inclined we could find something to begin enforcement actions against a carrier's operating authority most any time we want" this is akin to a cop saying they could find something wrong with a vehicle if you piss them off enough. The FMCSA does audits mostly by a schedule. It's MUCHO additional paperwork if they go all hard on a carrier. They don't unless a carrier gives them a reason. This was how it was explained to me BY an FMCSA auditor at the Atlanta field office about 10 years or so ago. My numbers are examples ONLY! If say Swift has 100,000 units and they have say 250,000 HOS violations per year this is 2.5 violations per unit a year. If JB Hunt has 75,000 units BUT has 250,000 HOS violations a year this is almost 3.5 violations per unit. If say OUTLAW trucking has 1,000 units and has 30,000 violations a year, that is a 30 to 1 ratio. The FMCSA WILL start enforcement action on that carrier. Yes, they do this kind of math. I might also add that both Swift and JB Hunt will get warned to lower those violations. @brian991219 also deals with this as well. As I said, the FMCSA will not place a driver's photo in a post office for a HOS violation, but that driver's carrier had dang well better show their efforts to stop these violations.

    A carrier safety critter is NOT there to be your friend. In fact, most are trained to stay on point when counseling a driver. Safety has ONE job, ONLY ONE! To protect those numbers on the side of those tractors, lose those numbers and EVERYBODY goes home!

    Just remember this, next time don’t use your last hour unless you are within minutes of stopping at a place you know has parking, since you know that no matter what, the company will point it’s finger art you.

    Company has to be able to show DOT/FMCSA proof that they don't ignore HOS violation. They prove it with a letter "wagging their finger at you" and telling you not to violate HOS.
