Walmart claims they “over paid” me

    This sounds like a peoplenet mistake...ask them to specify where the overpaymewnt came from. Did you get a safety bonus? There have been a lot of pay mistakes lately and this sounds like one of them.

    The Regulations say the motor carrier has 45 days to settle with the driver after employment stops. Anything past 45 days they and the driver have no claim.

    If you wouldn't mind referencing that regulation - if I'm not mistaken, that applies to O/O's and maybe Lease Op's and may be out of context.

    OP was an employee, subject to wage and hour law. OP has a right to documents proving the cause of the overpayment but if the error is legit, must repay. The law looks at it as "unjust enrichment", same as if you found an extra couple thousand in your bank account. Not yours to keep. I believe they have to offer a payment plan if funds are not immediately available to pay in full.

    Disclaimer: I'm not a lawyer... I just play one at the lunch counter. :)

    I think you're right it applies to owner operators only. But still, for them to come back a couple months later seems way too late to recover funds. I think it would be worth it to talk to a lawyer about it.
