Warning from DOT/Shotty company equipment/Need advice

    Well, if you drive it and its not safe, kind of goes hand in hand. However a equipment violation should have nothing to do with your next job. I have worked for companies like that, the way I handled it, returned from Texas, parked the truck, went in and told the boss Im ready togo back out as soon as you put legal steer tires on that tractor, they were @ 2/32nds when I parked it, 2 weeks later ran into an idiot in Pilot driving the Fiberlay truck with steel showing on the drives

    Are you working for a hole in the wall type of company? That'd be my guess if they're too cheap to fix faulty equipment. That should be one of the things every driver looks for in a company. When I was a less experienced driver, I went down the road of working for a cheap owner, and it beat up my CSA score. You didn't get an inspection this time, but eventually, your luck will run out. If it were me, I'd start putting in feelers to see if there are companies to work for that are more equipment-focused on top of paying well.

    Im a driver with less than 2yr experience. Yes it’s a hole in the wall type place. Riding around today with check engine light, 0 tread tires with chunks missing, tcs, and trailer abs lights on and a fuel tank leak.

    Definitely going to put some feelers out because you are right, my luck will runout if I continue here and they don’t fix it. Going to give the ultimatum, fix it or I leave. I have a feeling I’m leaving :D

    As someone else already said my experience is that if the warning is on a DOT inspection report then it will go on your PSP for 3 years. Crashes stay there for 5 years (regardless of fault.) And a DUI will stay there for 10 years. Warnings are borderline unfightable so I've heard of some drivers asking the inspector for a citation instead but you do so at your own risk.

    Something else you should be aware of, there are three major records that you'll want to check about once a year to make sure that there is no inaccuracies on your record. ( had that happened to me once, the state of Illinois mistakenly submitted a red light conviction on my MVR, had to get a court order to correct that.) The records that you want to check are: your MVR, your PSP, and the DAC report.

    The MVR is your Motor Vehicle Record, usually only convictions on a citation go in there.

    The PSP is Pre-employment screening program, I already explained what goes in there earlier.

    Both MVR and PSP are government operated, the MVR by the state of residence and the PSP by FMCSA.
    The DAC report is operated by a company called hireright, which is filled out by hireright customers; ussually previous carriers you've worked for.. however, it should be noted that not all carriers will pull a DAC report.

    my company has stated they are going to try and fight it with their lawyers. Is this even possible? It is a warning, not a citation. They said there is a strong possibility of getting it removed off CSA. I’m assuming they only care about their CSA, if they are successful in removing it from the company, does this also remove it from my name?

    Personally I would first find out if you even have a record to do data Q on, so go ahead and pull your PSP report if you haven't already. It cost no more than $10. Should it take you any more than 10 minutes assuming you already have a FMCSA account.

    Spare them the ultimatum. They'll see the writing on the wall when prospective employers start calling them for verification. Let your actions speak to them for you.

    Remember one thing, there isn't a single driver that is valuable enough to force a company to do things with an ultimatum. The thing that hurts companies most is drivers that leave.
    Too many options out there.

    If the inspection paper with a "warning" was not seeing or signed, there should not be any further actions.

    Look for better company. The every day stress of constant worry, even subconscious one that was shoved down, will eat you up and produce many unneeded female hormones. Those will eliminate male ones and then you may confidently subscribe to follow "them" gender.
