Weigh station violation, but no citation.

    I have a CA cdl, but was going through MO and got stopped at a weigh station. I have had my license for less than a month and still learning the elogs. My husband (co-driver) was super tired and had fallen asleep. I had logged in (or so i thought) in order to get us about 20 miles to the truck stop. When the officer did the inspection, due to the truck being overweight. I got a violation for false records and the overweight. I hadn't actually swapped us, so it looked as if i were in sleeper driving and he was driving but in sleeper. I had just come off my 10. I was cited for the overweight only. How will thos affect my license? Please assist! Thanks

    One, being over weight. But both are listed on the vehicle examination report.

    Like i mentioned I am a new driver and wasn't aware that all loads need to be CAT scaled.

    Yes he should've. He can be a bit sometime. Lesson learned.

    Sounds like you started driving before your 10 hr break was up. If not I can't see why they would have put you oos for 10 hrs.
    The overweight thing won't be a problem, but your company may have something to say about the rest of it.

    There was still about 15 minutes left on my drive time when i logged on.
