If you could have avoided it in any way, however inconvenient or nonsensical, it will probably be counted as preventable against you by the company. That said, depending on the company, they will probably fight the lawsuit. They usually only throw you under the tandems internally. My company is really nice but they will still record a preventable if you don’t slow down or get over for traffic coming onto the highway, assuming either of those was an option. The fact that you stated you saw them there in advance trying to get in and didn’t yield(even though you’re within the law) means you could have prevented it. Sounds stupid and it is, but it’s also the truth.

I was giving a training ride to a CDL holder who came from NYC limo's. He and I toured Brooklyn making a delivery and I learned his take on NYC drivers...'DON'T LOOK 'EM IN THE EYE!" just power thru. The split second they see your eyes, they will take off knowing that you DO see them...
It matched something i had heard years before from a driver who went for bus training in NYC. They started out with an empty bus and hit the curb around wall street at 4pm.
As the bus was filling up he asked the driver how he was going to pull out in the crush of traffic.
The training driver answered "Like this; clicked on the blinker and after one flash he pulled out and drove on..."

I only lightly skimmed this thread. However if I understand it correctly the OP had a bumper bump on the GW. This is why I NEVER used the GW during the day. I always used I 278 to the Tappan Zee. I understand this bridge is down now. While it was a bit out of the way the ride was a much more peaceful ride back to I 95 in Conn. The stupidity of the traffic on and around the GW used to be so crazy my company would allow me to totally avoid NY and go up to Conn going to I 84 using I 81 if I were coming from Ohio on I 80. The GW was the one place I hated so bad I would even go around it without my company saying it was OK.

Yeah man i was gonna take 278 and go 100 miles off route but decided not to im one stupid mother####er for that got to the nj rest area with 22 minutes to spare then did 10 min post trip was on my 14 never again now im almost certain ill get fired since it was preventable messed up part i gave way to the guy after he got like he was but he started to move forward and caught the corner of my feont bumper the pointy end near the steer the damage speaks for itself the way my bumper has a small indent from someone pushing forward and the cut on his car it forward like he dragged his car on the pointy end but still i wish i would have just let him in even tho he didnt deserve it would have saved my career now its over. I wonder what they will put on my dac dosent help driver facing camera i was pissed off swearing very unprofessional i just absolutely hate nyc worst day ive had in trucking. I wonder if ill be able to get another job. With this on my dac. -
It's all in where you are coming from. If your coming north on I 95 it is a bit out of route but I don't think it is quite 100 miles. If coming from I 80 and I 78 even less. Today I don't think it is an option. Last I heard the TZ is down. The point was to avoid the GW during the day. I have parked and done a 10 in NJ just to get up at 3AM and cross the GW. If you can always try to trip plan to avoid NY.
