Why are u all sueing all these companies?

    The company paperwork is usually careful to not PROMISE stuff but only suggest to eager newbies in a way that SEEMS like a promise. You cannot sue a company because you didn't read the paperwork,

    I understand 'no one can force anyone to do anything', there is a thread opened here on the forum where that particular situation has been talked about in a greater detail. I flew in from overseas, boarded 3 airplanes to get to Omaha (South Sioux City) to start driving for the company, was I supposed to quit on Day 1 or most people would call it rushed and tell me to give it at least a few days before making the final decision?! Rhetorical question. Should I have refused to do what I was told to do, sit in the truck in the middle of nowhere without being paid until the company fires me for refusing to work?!

    It's a digression to this thread's subject, I mentioned my case to say the officer out of Lincoln NE sounded like he is company's defense lawyer. Nebraska is a small state with less than 2 million people, is the State going to be biased toward a business with $50+ million a year in revenue headquartered in Nebraska and disregard a single driver's complaint?! Nebraska is a deep red state, I heard one lawyer said conservative judges tend to be more on the side of the business.

    Bottom line, a single driver is small and the trucking company is big the way things are.

    I agree.
    It is not easy for a single truck driver to go against a trucking company's shady business. Class-action lawsuit/mutual effort seems to be the way to go for truck drivers to get justice served, there is more money in class-action lawsuits for lawyers to spend time and resources to tackle a trucking company.

    What!? The Nebraska DOT has dirty officers!? I'm shocked!

    Or I would be if I didn't know the reason the scales in Nebraska are staffed by the state patrol instead of DOT officers. Why is that? Well, apparently when the DOT ran them, very often drivers would be told they were 400 pounds overweight, but they could skip the ticket if they'd leave a 400 pound box of frozen steaks next to the scale. Don't worry, the DOT guy will put a new seal on your trailer. They got busted, and now there's no DOT at the scales in Nebraska.

    And in this Swift case, it might actually be worth it. $100,000,000 divided by 19,000 drivers comes out to $52,000 and change for each -- but keep in mind that the lawyers will get a third of that. Still worth it, I suppose.

    The other cases mentioned in the article? Not so much.

    Werner: $780,000 / 52,000 students = $15 apiece.
    CR England: $2,350,000 / 6,000 = $399 apiece.

    Anyone suing for recruiters lying? $0 so far as I can tell.

    CRST lost a suit against TransAm for stealing their students.
    Court squashes $90M claim that Olathe company was illegally recruiting workers

    TransAm also beat a $100 million class-action suit very similar to the one in the example above.

    Bottom line is whether it's worth it as an individual to spend your time and energy trying to get justice from the courts for this sort of thing, or more beneficial to just move on. Personally, I'd rather make $400 by hauling a 600 mile load today than wasting hours and days and weeks and months and years trying to get some big company to change their behavior. I already know they're all greedy. The question is, will they pay me to do the job they are offering?

    With all of this talk of litigation, here is a scenario for you:

    You have a nickname you've had to deal with for over 20 years
    You dislike it. You detest it.
    You. HATE. it.

    You start working at a new company, and inform owner of said company of this nickname, that it's followed you for decades, and said owner says it won't be a problem.

    After working there for a month, you are called said nickname twice, by two people, in less than 2 minutes time on Friday, and let the owner know in person since he's at the terminal.

    You go home for the weekend. Monday rolls around, and you're having an anxiety attack because of what happened on Friday, and you don't want to go in for fear of being called said nickname again. You email the owner, letting him know how you feel, and you won't be coming in to work that day.

    Owner subsequently fires you.

    Before you say "get thicker skin in this industry" please be advised:
    It's harassment
    20+ years of it has potentially caused PTSD

    So, what would you do?

    You know the sad part?? Half of the American population (Notice I say American) Will read your post (If It were possible) AND STILL TRY TO SUE....

    Even many on here will read such a beautiful,illustrious,Truthful Post and Ignore it with no comment as they Giggle with Siblings or Spouses trying to Get that $100k Payday.


    This kind of stuff doesn't happen in other countries of any regularity., Their more Civil- Only In America Where Greed And Stupid Thinking MAY get you a Trial-

    Well if the idiot was dumb enough to inform the company, a bunch of people who never knew the nickname, about this nickname, then yes ge should have thick skin. PTSD my ###

    In the USA you get all the justice you can afford and the trucking companies can afford more and better lawyers than the drivers they screw over which is why drivers still get the shaft and the business model never changes. It’s been just as corrupt since I first drove a truck back in ‘99 and will suck just as bad if my grandkids decide to drive.
