It's always an option. The elog is not hard wired into a drivers brain. He or she has a choice.

And even if you had a sleeper there is a high probability there was no safe legal place to park.

Sometimes things happen. Hos was never intended to be some written in stone thing. It's strict, but not so strict you should be parking on the #### interstate to take your break.

Going over cause you are trying to get through a major city at 5 pm with only an hour and a half on your clock? That's bad planning and if caught you are most likely getting a ticket.
Get stick in a truly unpredictable event? Keep going till you get to a safe location, make a notation, and no one will ever say a thing to you. Assuming of course you take a full break and aren't continuing on over hos to make the delivery appointment.

Oh come on mack. You aren't some tin hat wearing fool that actually believes someone will give you grief over the #### interstate being shut down trapping you in the left lane with no where to go for half a day.

Well, I’m personally of the opinion that I’ll do what I have to do in order to be able to shut down for the day safely.

The other side of the coin here though is the ubiquitous and parasitic figure known as the “slip-and-fall” lawyer, and this may explain the grief you’re getting here.

Who? The dot? A safety guy at your employer? Some idiot truck drivers?

Also, was that storm expected to be that bad or was it a freak thing like what i experienced in ky. God i wish i could remember exactly when that was. Want to say it was the winter of 14/15. We were stuck so long people actually abandoned their vehicles and started walking.

They set up shelters a few miles south of us and were stopping on the south bound lanes to let people stuck in the northbound lanes to get in busses to transport them to the shelters.

Not true. There’s never an instance where you should violate the HOS.

I get the fear of lawyers. However that is a civil matter. We are discussing fmcsa directives, not what a slums ball lawyer can twist things into if some idiot runs into your icc bar after traffic starts moving again.
