Hazmat ticket, entering a prohibited tunnel

    Hi everyone, my cousin when into a prohibit tunnel, police stop him before entering, with hazmat load, he got a ticket. Is it worth hiring a lawyer, anyone please, tks

    Prohibited tunnels and restricted roadways are usually well marked so it will be hard to defend.

    Tunnels have cameras.

    Definitely not.
    Tunnels are always prohibited and this information is widely distributed during Haz Mat training.

    Places with patrol officers on-site are always well marked, like the harbor tunnel and I-895 tunnel in Baltimore....

    Not to mention the 'all hazmat exit here' signs....

    Yes. It might be a misdemeanor. In Ohio it can be a misdemeanor. So it's criminal as well as a traffic ticket.

    You said you're cousin went into a tunnel, but then said police stopped him before entering. Which is it? Depending on how the law is written on whether it is worth a lawyer. IF he didn't enter the tunnel and the law says it's unlawful to enter a tunnel, then there is no law broken. Where did it happen?

    It also depends on the citation. Like you said if it's for entering the tunnel and he didn't...
    But if its for ignoring the several hazmat trucks exit here signs he might have a bit more trouble (Failure to obey traffic control device.)

    I would not hire a lawyer. At most, I’d talk to the DA and beg their mercy. Be their back door man if they need one. Give their pooch a good scrubbing and brushing if they’d like, tell them you’ll do just about anything to earn their mercy. Frankly, I’d even give them one my fresh Kentuckians if they wanted one. Not like I can’t get another.

    Full disclosure: I’d only do all of that if the DA was HAWT! I figure even if she said she wasn’t going to do old Frank a solid, at least I still got to feast my eyes and sense of smell for a bit.

    Big Maude ain’t known for either of those.
