i would be one pissed off mo fo if that was me, of course i wouldn't fire a warning shot. only shot i would fire would be aimed at the thief.

never said id shoot them in the back while they were running away but i would shoot them or not shoot at all.
probably where he ended up in trouble is if he shoots a warning shot it would indicate that he was not in immediate danger at that moment in time therefore illegal to fire a gun within the city limits by the local law. the second i saw a gun pointed at me though it would be open season. weather they were driving away in there car or not. but in this guys case that was after the fact of when he had already discharged his firearm.
