    Guess 395.8 is optional then?

    Think I've seen this video on YouTube;

    "I know my rights! "

    Window smashing, handcuffs clicking tighter

    "I dont recognize your authority!"

Wouldn't they most likely shut you down for 34 hours if you had no logbook at all?

Yeah - I think you’re probably right there.

“The dog ate my log book”

    “Well, where’s the dog then?”

    “I got hungry”.

First offense would be probably a fine and shutdown for 10. Unless you try to play truckstop lawyer.

Sometimes you have to break one regulation to be legal in another regulation. Things I have heard drivers do is arrive at the customer hours early and log just a few obligatory minutes On Duty then record the rest of the time Sleeper or Off Duty. Some of these drivers' 14 hour clock expires before their appointment time. They just creep into the facility at the appropriate time still S or OD get (un) loaded and creep back out to the street to complete their break. It is the new normal.

It is either violating private property, they can call a sheriff, if you insist on staying there - it is criminal to trespass, isn't it? - or violate HOS - notably 14 hours limit, invented by morons - the previous regulations of limiting the work of no more than 15 hours in 24 hour window, was much more practical. The morons knew better, though. I am sure they even wrote a nice scientific white paper, justifying their decision - for sure backed by some twisted data and lab tests. I'd put them in a semi and said "Now. You show me how you like your regulations - go earn some living but remember Safety First! " LOL

With PC you can bend the guidance to your own advantage due to the lack of its preciseness, I think, in what you can do after completing the work e.i. being empty. It is more complicated , when you are picking up for too long. Shippers / Receivers don't care about Elogs, they never did. The attitude has not changed, it seems.

Forget about trying to dodge the logbook
Take a gander at income tax
Don't you know you aren't legally required to pay it?
    :happy1:

I hope this cowboy keeps the dot occupied so they have something to do rather than hassle me for maybe being 34200 cuz they're bored. Thanks dude!

That depends. The officer can place you OOS for as long as necessary for him to be satisfied that you have hours available to legally drive. If he looks up your truck and you've crossed scales on the east & west coast twice in the last week and a half and you're in the midwest on your 3rd trip cross country, yeah...you'll be sitting for 34. If you appear fresh and he can't find anything to indicate you've been running excessively hard, you'll likely only get a 10...unless you're a donkey, in which case he'll probably perform a thorough level 1 (and it WON'T be "clean") in addition to sitting you for 34.

Sorry, but I'm not going to type out "he or she" several times throughout the course of a reply when a simple "he" gets the point across just fine. Up until all of this PC bullcrap took over, it was the common way to refer to a non-specific person.
