Last year I received 2 speeding tickets in the state of Louisiana. For the record I've been trucking for 31 years and these are my only speeding tickets. Back to my question. I hired a good attorney and had both reduced to non moving violations. While they do not appear on my driving record they still show up when someone does a background check for a CDL driving job. How can something that I wasn't convicted of show up on my background check? Has anyone had this happen to them and were you able to do anything about it? Any knowledge or expertise would be appreciated. Safe travels.

I believe FMCSA requires the original charge be shown, but that you were convicted of a lessor charge, or at least that is what I overheard our Safety guy telling another driver about a citation he received.

You had the tickets reduced, but in doing so you are still guilty of the non moving violations, which are misdemeanors and is why they still show up on a back ground check

I found this slide in an FMCSA Presentation I went to last year for a project I was doing for a carrier. It is a slide showing what happens when you receive a citation and the various outcomes. It will show up you were cited for speeding, but will show what you were convicted of.

They are a joke. Try to call and its 20 minutes on hold. File a complaint and they pass the buck. I had the same question-how can a ticket I haven't even been to court for be on my record? Finally went to court Friday and got it dismissed, but have missed several jobs because of that. Contacted two companies today and they said as soon as it's off your record you are good to go. It will take a week. This is very unfair. Several companies went ahead and declined me up front. Can't unring a bell.Last edited: May 21, 2018

The government is so two faced on this. The government and politicians publicly clamor and yell about how they are so committed to creating jobs, but behind the scenes they create huge obstacles, and huge hoops to jump thru to get jobs, especially in the transportation industry. Far from being judgmental - the post reminds me that I'm always better to back out of it than mash on it if safe to do so - because I've dealt with enough bureaucratic garbage in my short time that I always appreciate constant reminders like these to be a compliant operator.
