Failed engine overhaul can I collect lost revenue?

    I had S/S over haul my engine DD15
    The over haul lasted 1 week.



    Towed it to freightliner S/S finally paid for all the
    Overhaul again.

    after going back and forth, it took all of 10 weeks for repairs it to be done.

    But they did pay for it in full.
    Can I go after them for lost revenue?
    Any attorneys you guys might know.
    The shop is in Wyoming, but I live in WA state

    How good are your books? If you go after them for downtime they will average your income and then look at all your expenses and your daily rate that’s left probably wouldn’t pay for the lawyer you hired to get it. It’s not as simple as saying your truck was down for 10 weeks so you want $50k.

    Agreed - they sure ate all the profit on that one making it right.

    If repair shops paid for truckers lost time, they all would be out of business.
    I am 99% sure you don't have a case

    You might have a case, but you need to consider lost revenue due to court time, attorney cost, etc…

    Frankly, I’d consider myself lucky they agreed to a second OH on their nickel without having to take them to court. And, your total time down was 10 weeks? With todays parts shortages, we’ve had trucks down for two months waiting for parts.

    He should be Thankfull they actualy did that ..70% of the shops would find a excuse not to pay
    Theres a old say'n .. Don't look a gift horse in the mouth..

    You might, only a lawyer could tell you for sure. Was it 100% the fault of the mechanic who did the work or was it a component failure? In my opinion, which isn’t much, I’d be happy with getting made whole again without paying out of pocket. If it’s anything like trying to get downtime out of an insurance company there won’t be much left to squeeze out after they take your average revenue and then do all the calculations.
