signing contract or pay employer if you resign before times up

    Out looking as a CDL Holder with no OTR experience I am noticing companies are starting to have the new CDL holders sign a contract for a year. They want to recoup their training costs. Some companies the payback amount is the same as someone who has no CDL, and some are a fraction of it. While I realize their is a cost to training, this is the only industry I know of that gets away with having folks sign contracts to get training to get their CDL, and now they are starting to have you sign a contract to to get the behind the wheel training when you already have your CDL to get the experience. I found one place that has a $3,500 contract, and a 1 year promise, with or without a CDL, I took them off my list.

    Sounds like a generic contract. It will have that on there because it is generic. Get a black marker, cross out everything that either you do not agree with or does not pertain to your situation and initial those blots. Then sign. If they have a problem with that, you walk. If not, be sure to keep a copy.

    And as important, make sure someone with hiring authority in the company signs and dates it to.

    This is an example of an unenforceable contract. There is no way one can predict what will happen in the future in an employment situation. Let's say you work there 4 months and hate it. The next person you talk to that is in authority will say something that offends you. Write it up and quit. You could be assigned a tractor that has a smell that is making you sick. Write it up and quit. You could have over heard an offensive joke. Write it up and quit. You could feel like your religious views are not being respected. Write it up and quit. The best one is that the company is trying to make you do something unsafe. Write it up and quit, then sue.

    BTW, kudos to you for reading your contract.

    Ever go to buy a used car and the window sticker in the car says "Price: Please See Sales Person"? Then you go inside and ask for the price of the car and the salesman starts trying to figure out what hand you're playing. "Any down payment money? Let's do a credit check." So, you spend hours, and you're tired and frustrated and you finally go and see the finance officer. He wants you to sign a contract. On the contract, there is a $1500 delivery fee and a $250 processing fee. Waitaminute...I thought that we AGREED on a price. How can they charge me an extra $1750???? Generic contract, and those fees are automatic on every contract. They add in the figures and numbers for your car. I've taken a black marker, blotted out the fees, and use a calculator, refugees the totals back to the price that we agreed on, sign the contract and hand it back to the finance officer. They get pissed. I don't care. If he can't agree to the amended contract, I walk and my money stays in my pocket.

    Anyways, I do the exact same thing with trucking companies when they have me sign their operating contract. In the contract, it states that I will agree to take my truck to a place of their choosing to have their Qualcomm removed or pay $3500. I will hand you your Qualcomm in a box after I get home. I agreed to pay a monthly fee for the Qualcomm operation, and that's all I'm going to pay. I didn't pay to have it installed, I will not pay to have it removed. The little secretary will look puzzled, and have to go into an office to see someone who can make a decision, but they always agree, and both parties sign off.

    Anyways, I am no legal expert, but if I don't agree with something 100%, I change it. Then I sign.

    Maybe I will check out Prime or Heartland Express. This contract makes me feel that they can't keep drivers.

    Or what?

    Is this a contract just for work?

    If it is name the POS company.

    They do offer tuition reimbursement but most companies do. The contract is supposed to cover training costs I guess. I would have jumped right on board but the contract made me feel like a slave. At only $100 a day to train. 32 cpm to start I think up to 40 cpm after one year.

    Not all do the tuition thing go find one that will just hire you, get in the drivers seat and pay for it yourself. but overall screw the idea of a contract. There is no costs that can be charged for you being hired.

    This is one of those cheap carriers/owners that need to be out of business, taking advantage of drivers is a scum move.
