Warning ticket result of Apu exempt

    I was pulled in Maryland today overweight gross. 6 or 8 hundred pounds. Wasn't until after the inspection and officer left I said to myself wonder of he gave credit for apu exemption. Went over and inquired while he sat in vehicle preparing ticket and guess what he totally didn't and said if I hadn't brought it to his attention I was screwed. So he let me off with a warning for discharged fired extinguisher that accidentally happened last week when I was placing it in side box. Guess I just get hit on csa. How many points anyone know?

    That APU exemption is only for the weight of the APU, which is about 400-500 lbs. Its not accepted in every state, and in some states it's at the whim of the DOT. You got very lucky with that fire extinguisher warning.

    CSA he was better off with the overweight as there are no points. If he had given a warning for the fire extinguisher anyway, then getting rid of the overweight saved him some coin.

    He could have also written you up for that fire extinguisher not being "readily accessible". That means it can't be locked in a side box or buried under a bunch of stuff.

    §393.95 Emergency equipment on all power units.
    (a) Fire extinguishers—
    (4) Condition, location, and mounting. The fire extinguisher(s) must be filled and located so that it is readily accessible for use. The extinguisher(s) must be securely mounted to prevent sliding, rolling, or vertical movement relative to the motor vehicle.

    Yeah, what's a $20 ticket with nothing else compared to points? I guess I could understand being stuck in place due to over gross, but it doesn't sound like that was happening.

    I once asked about the APU exemption at a New Mexico scalehouse, and the officer told me that federal regs allow a CMV to exceed 80k by the weight of the APU or 400 lbs, whichever is less.

    Of course, having a good attitude when talking to LEO can always tilt the odds in your favor, and vice versa.

    Overweight carries no CSA points to the carrier and no PSP reporting to the driver. You just talked yourself into a warning that does carry those points and reporting.
