"Legally parked" is a rational term. I hope the driver had a very good reason for parking on the shoulder because it is against the law in all states to park(flashers or not) on the shoulder other than an emergency.

I never park on the shoulder unless extreme emergency. If I get loss I just keep going and get off the next exit, then get back on the other way.
Today my straps start coming undone. I didn't stop on the shoulder, I waited till thr next exit, mainly cause I was empty and a strap flapping isn't a big deal and not an emergency. -
Not sure if anyone remembers, but many many years ago a CFI driver parked on a ramp to catch a nap, a drunk fell asleep at the wheel, went off the road and crashed into CFI's truck, killing her passenger. The lady admitted to driving drunk and falling asleep at the wheel, but in a civil case the family of the passenger was awarded $18 million because a shoulder of a ramp isn't legal parking, and the truck driver didn't have out his triangles.

The safe thing to do is find a rest area or exit ramp to park temporarily and make phone call, check for directions, etc etc....because it is in the interest of public safety.

I blew a steer tire and sat on the shoulder of I-35 for about two hours a few months ago. The most nerve wracking two hours of my life. Most that could move over did but this was just beyond a curve and when two abreast came around the bend, well most managed to move over for me.
I've never had a drive or tandem tire replaced on a shoulder nor have I ever had a problem limping to the next exit for road service or to stop at a strategically placed TA or Loves. NEVER in a million years would I stop on a shoulder unless I was broke down or disabled due to a steer tire.NavigatorWife Thanks this. -
